TERMS OF USE · DEVELOPMENT DRAFT
Use it to look closer.
Keep your judgment.
These draft terms describe the current product preview and the intended boundaries of the planned ToneGrain app. The publisher identity, governing law, release date, and consumer notices remain to be completed before distribution.
This website is a static preview. It does not provide a public app download, paid plan, or live AI analysis. The final publisher’s legal name, support contact, governing terms, and any region-specific consumer rights language must be supplied before the app is offered to the public.
1. Agreement and publisher
These terms are intended to govern access to the ToneGrain website and, when released, the ToneGrain iOS application and related services. “ToneGrain” is a working product name, not a confirmed legal entity. The person or company contracting with you and its contact address will be identified here before release. If you do not agree to the final terms, do not use the released service.
2. Eligibility and your device
You must be legally able to enter into an agreement where you live. If you are permitted to use the service only with a parent or guardian’s consent, that person must review and agree to the applicable terms. You are responsible for your compatible device, operating-system account, network access, and any carrier or data charges. Availability may vary by country and device.
3. Development website and service availability
The current site provides product information only. Features, descriptions, sample layouts, and release timing may change during development. We do not promise that a preview feature is complete, continuously available, or suitable for a particular purpose. The app, AI service, and purchases are not available from this preview. We may suspend or change preview pages for maintenance, safety, or development.
4. App features and local records
The planned app helps you examine visible wood surfaces, save analysis snapshots and notes on your device, browse available reference material, and keep lightweight guitar records. Local records are stored on your device rather than in a publisher-hosted user account. You are responsible for maintaining your device and any backups. A user-created ZIP backup is not encrypted by the app; protect it as you would the photos and notes it contains.
5. AI results are informational
Photo analysis may provide candidate material identifications, visible-grain observations, a visual assessment, and sourced general context. These outputs are informational and probabilistic. Lighting, camera quality, angle, finish, wear, image editing, and limited visible features can affect them. The app may be wrong, incomplete, or unable to identify a material. An “insufficient” or “not observable” result is a meaningful limitation, not a diagnosis.
A photograph cannot reliably establish exact species in every case, whether a body or component is solid or laminated, internal construction, provenance, authenticity, supplier grade, commercial value, moisture content, stiffness, structural safety, or the acoustic behavior of a finished instrument. A visual assessment is not an industry grade or a substitute for an independent expert. General tonal references are not a sound measurement and do not predict how a particular finished guitar will sound.
Do not rely on an app result as the sole basis for a purchase, sale, valuation, repair, safety decision, or representation to another person. Inspect the instrument and seek a qualified luthier, appraiser, supplier, or other professional when the decision matters. You are responsible for independently checking claims made by a seller or manufacturer.
6. Your photos and submissions
You retain whatever rights you have in photographs and notes you create. You confirm that you have the necessary rights and permission to submit an image for analysis and that doing so does not violate another person’s rights or the law. Do not submit unlawful, infringing, confidential, or sensitive material unrelated to the requested guitar analysis. The planned service sends images to an identified third-party vision provider only when you choose analysis; the provider and handling terms must be disclosed in the Privacy Policy and in the app before this feature is enabled.
7. Acceptable use
You may use the service for lawful personal research and guitar-related reference. You must not interfere with the service, probe or bypass security controls, reverse engineer it except where the law permits, use automated means to overload it, misrepresent its output as a professional certification, or use it to infringe rights or deceive another person. You must not attempt to extract provider credentials or use the service to process content you have no right to submit.
8. Purchases, subscriptions, and cancellation
No purchase is offered through this preview. If paid app features are released, their features, price, billing period, renewal rules, trial terms if any, and cancellation instructions will be shown clearly before purchase. Apple processes App Store transactions under its applicable terms. Subscriptions generally renew and are managed through the Apple account settings unless the purchase screen states otherwise; the final purchase flow and local law control. Any price examples in development materials are not an offer and may differ by storefront, currency, tax, or future changes. Required refund rights remain subject to applicable law and Apple’s process.
9. Intellectual property
The service’s software, interface, text, marks, and original materials are owned by or licensed to the publisher and protected by applicable law. These terms grant you a limited, personal, non-exclusive, non-transferable right to use the released app and site for their intended purpose, subject to these terms. You may not copy, distribute, sell, modify, or create derivative products from publisher materials except as allowed by law or with written permission. Third-party reference materials remain subject to their respective rights and licenses.
10. Third-party services and links
The app may rely on Apple, a purchase-management service, a hosting provider, and a vision provider to deliver particular functions. Their services are governed by their own terms and privacy notices. We are not responsible for independent third-party services, their availability, or changes to their terms, except where applicable law provides otherwise. The final service providers and relevant links will be listed before release.
11. Changes, suspension, and termination
You may stop using the service at any time and may uninstall the app. Local data may be removed by uninstalling or clearing app storage; export anything you wish to retain first. We may update or discontinue features, and may suspend access when reasonably necessary to protect the service, users, or comply with law. The final terms will explain any notice and account process applicable to released features; the planned app does not require a publisher-hosted account for local records.
12. Disclaimers
To the extent permitted by law, the development preview and any released informational analysis are provided without a guarantee that they will be uninterrupted, error-free, accurate, or suitable for your particular purpose. We do not guarantee a specific identification, result, tonal outcome, or commercial decision. Nothing in these terms excludes a consumer guarantee or other right that cannot lawfully be excluded. Any additional release disclaimers must remain consistent with mandatory consumer law.
13. Liability
To the extent permitted by applicable law, the publisher will not be liable for indirect or consequential loss arising from use of an informational result, including a purchasing or valuation decision made without independent verification. Nothing in these terms limits liability that cannot legally be limited, including liability for fraud, intentional misconduct, or any mandatory consumer remedy. The final version will define any lawful liability limits and exclusions for the relevant jurisdictions.
14. Indemnity
Where permitted by law, you may be responsible for losses directly caused by your unlawful use of the service or your infringement of another person’s rights. This section does not apply where prohibited by consumer-protection law and does not remove any rights that cannot be waived.
15. Governing law and disputes
The publisher’s jurisdiction and governing law have not been supplied. The final terms will identify them and explain dispute procedures before release. Mandatory rights to bring claims in your home jurisdiction or before a competent consumer authority remain unaffected where applicable law grants them.
16. Changes to these terms
We may revise these terms as the product develops. The “Last updated” date will identify the current version. Material changes for released features will be communicated in a reasonable way and will take effect as permitted by law. Continued use after the effective date may indicate acceptance where legally valid; where consent is required, we will request it.
17. Contact
